Terms of Service

These Terms of Service ("Terms") govern your use of the HoloDream mobile application and related services (the "Service") operated by HoloDream ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using HoloDream, you confirm that:

• You have read, understood, and agree to these Terms
• You are at least 13 years of age
• If you are under 18, you have the consent of a parent or legal guardian
• You have the legal capacity to enter into this agreement

If you do not agree to these Terms, you may not use the Service.

2. Account Registration

2.1 Account Creation

To use HoloDream, you must create an account by providing:

• A valid email address
• A secure password

You agree to provide accurate and complete information and to keep this information up to date.

2.2 Account Security

• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account
• We are not liable for any loss arising from unauthorized use of your account

2.3 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent quotas, bans, or other restrictions is prohibited.

3. Subscription and Payments

3.1 Free Tier

HoloDream offers a free tier with limited daily message and voice quotas. Free tier features and quotas are subject to change.

3.2 Paid Subscriptions

• Paid subscriptions are available through Google Play
• Subscriptions are billed on a monthly basis
• Payment is charged to your Google Play account at confirmation of purchase
• Subscription tiers, pricing, and included quotas are displayed in the app

3.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through Google Play settings.

3.4 Cancellation

• You may cancel your subscription at any time through Google Play
• Upon cancellation, you retain access to paid features until the end of your current billing period
• After the billing period ends, your account reverts to the free tier
• Your conversation history and data are preserved regardless of subscription status

3.5 Refunds

Refunds are handled in accordance with Google Play's refund policy. We do not provide refunds for partial billing periods.

3.6 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated with at least 30 days' notice before taking effect. Continued use after a price change constitutes acceptance of the new price.

4. Acceptable Use

You agree to use HoloDream responsibly. The following activities are prohibited:

4.1 Harmful Content

• Generating content that promotes violence, harassment, or discrimination
• Using the Service to harass, threaten, or abuse others
• Creating or distributing illegal content
• Generating content that sexualizes minors

4.2 Service Abuse

• Attempting to hack, reverse-engineer, or compromise the Service
• Using automated tools, bots, or scripts to access the Service
• Circumventing quotas, rate limits, or other restrictions
• Sharing, selling, or transferring your account to others
• Creating multiple accounts to circumvent restrictions

4.3 Intellectual Property

• Do not use the Service to infringe on the intellectual property rights of others
• Do not attempt to replicate or extract our AI characters, prompts, or system configurations

5. Content and Ownership

5.1 Your Content

• You retain ownership of the text content you create through conversations
• You grant HoloDream a limited license to process your content solely to provide the Service (generating AI responses, maintaining conversation memory, creating summaries)
• This license terminates when you delete your account

5.2 User-Created Characters

• Characters you create within HoloDream remain your intellectual property
• You grant HoloDream a license to host and process your characters to provide the Service

5.3 HoloDream Content

• The HoloDream platform, software, pre-made AI characters, and all related intellectual property are owned by HoloDream
• You may not copy, modify, distribute, or create derivative works based on our platform or characters
• The HoloDream name, logo, and branding are trademarks of HoloDream

6. AI-Generated Content

6.1 Nature of AI Content

• All AI responses are generated by artificial intelligence, not written by humans
• AI-generated content may be inaccurate, incomplete, or inappropriate
• AI characters are fictional entities and do not represent real people or organizations

6.2 No Professional Advice

AI-generated content is not a substitute for professional advice. Do not rely on HoloDream for:

• Medical or health advice
• Legal advice
• Financial or investment advice
• Mental health treatment or crisis intervention
• Any situation requiring professional expertise

If you are experiencing a medical emergency or mental health crisis, please contact emergency services or a crisis helpline immediately.

6.3 Use at Your Own Discretion

You acknowledge that AI responses may contain errors or generate unexpected content. You are responsible for evaluating and using AI-generated content at your own discretion and risk.

7. Service Availability

• We strive to provide reliable, continuous access to HoloDream but do not guarantee 100% uptime
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control
• We reserve the right to modify, suspend, or discontinue features at any time
• We will make reasonable efforts to provide advance notice of significant changes

8. Termination

8.1 By You

You may delete your account at any time. Upon deletion:

• Your account and all associated data will be permanently removed within 30 days
• Any active subscription should be cancelled separately through Google Play
• This action is irreversible

8.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in prohibited activities (Section 4)
• Your account is used for fraudulent or illegal purposes
• Required by law or legal process

In cases of termination for cause, we may delete your data without notice. Where possible, we will provide advance warning and an opportunity to export your data.

9. Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLOLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless HoloDream, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create or share through the Service

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

11.2 Informal Resolution

Before filing any formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days.

11.3 Arbitration

If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except for claims that qualify for small claims court. The arbitration shall be conducted in English.

11.4 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive the right to participate in a class action, class arbitration, or any other representative proceeding.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of this page
• For material changes, we will provide notice through the app or via email
• Continued use of the Service after changes take effect constitutes acceptance
• If you do not agree to the updated Terms, you should discontinue use of the Service

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HoloDream regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
